Experienced Trial Attorneys
First and foremost, the lawyers of Dowell Baker, P.C. are trial attorneys, not mere litigators. We have extensive experience in the courtroom trying intellectual property cases and commercial disputes. As trial attorneys, we take pride in our courtroom skills, including our skills examining witnesses, preparing expert witnesses, making arguments to a judge or jury and simplifying complex facts and data. We communicate to the judge or jury that even the most technical patent case or complex contract dispute has compelling human elements and important fundamental rights at stake. These courtroom skills are essential to the successful resolution of any business dispute, even if a case never goes to trial.
We recognize and appreciate that most cases settle prior to trial. The most favorable settlement, however, can often only be obtained when a case is fully prepared for trial and we send a clear message that we will, if necessary, try the case. We never allow our client’s settlement position to be determined based on lack of preparation or fear of trial, but only sound business considerations and the merits of the case.
Our courtroom experience guides not only settlement recommendations but also every other aspect of the litigation of a business case. We take care not to take untenable positions that might undermine our credibility with the judge. We do not waste time on discovery activities that will not help us to prove our claims or defenses. Instead, we focus our discovery efforts on obtaining documents and evidence that will help us tell a compelling story in the courtroom. In many cases, these efforts lead to success long before a case ever gets to trial.

Hard Work
Success in the courtroom depends on hard work outside the courtroom. Business litigation involves much drudgery, combing through box after box of documents to find that one document that wins the lawsuit, or combing through case after case to find the one legal decision that supports a critical argument. We do not shirk from this labor, but instead embrace the opportunity to discover evidence and case law that our opponents often overlook.
The demands of litigation often require long hours and sustained intellectual effort to meet short deadlines. At Dowell Baker, P.C., we have the youthful energy, stamina and ingrained work ethic to meet these demands. Unlike more senior attorneys who reserve their limited efforts for the courtroom, our partners are in the trenches reviewing documents and researching and writing the briefs. When we meet in the courtroom, we are often better prepared and better versed in the facts of the case.
We often oppose large law firms with legal teams staffed with two to three times as many lawyers as our own. Our cases are staffed leaner because we do not waste time and money duplicating effort or sitting in costly attorney meetings. We achieve success by working harder and smarter than our opponents.

Technology
At Dowell Baker, P.C., we also rely on advanced technology to level the playing field with larger firms. Success in business litigation requires the effective management of voluminous amounts of documents. Every document that enters or leaves the firm is scanned and maintained in a computer database. Case documents are immediately sent to the client electronically at no cost to the client or firm. Our database is also available to all attorneys at all times for easy location and retrieval of documents, eliminating the time and cost of locating paper copies of critical documents.
Success in the courtroom also depends on the effective presentation of documents, demonstrative exhibits, deposition testimony and case law. We utilize laptop computers, bar code scanners and a proprietary software system to quickly and effectively locate this information for immediate presentation to the judge or jury. Unlike attorneys who fumble around with binders of paper exhibits, we can immediately locate and present a particular document or case law decision with a bar code scanner. Unlike attorneys who rely on static PowerPoint presentations in the courtroom, we can present documents or demonstrative exhibits in any order, often altering our presentation based on the instantaneous testimony of a witness or questions from the judge. Our system of presenting documents to the judge and jury has proven to be a powerful enhancement to our oral arguments in the courtroom.
Partner Anthony Dowell also recently provided testimony as a witness in patent litigation concerning RealTime deposition transcripts and software. Mr. Dowell was one of the early adopters in the 1990’s of this technology that enables an attorney to get a live transcript of a witness’ testimony on a laptop computer during a deposition or trial. Mr. Dowell provided testimony on his early use of this technology, which he continues to use to his clients’ advantage in depositions and at trial.

Personal Service
At Dowell Baker, P.C., we remain in close, personal contact with our clients through all stages of litigation. All correspondence and pleadings are immediately sent to the client by email, along with regular, if not daily, email updates on significant events. Unlike large law firms, where a case may be shuffled off to a lower level attorney, our partners are personally involved in all aspects of our client’s cases and available at all times by telephone to discuss case developments. We take pride in our close relationships with our clients and maintain those close relationships through personal, regular contact with our clients.
